Messing's Immigration Factoids ™
In many states, document preparers can legally prepare immigration documents only if they work under the supervision of a lawyer. Other states have certification programs for non-lawyers which allow them to work independently. To be safe, only entrust immigration cases to qualified professionals. Unsupervised document preparers may themselves lack sufficient knowledge to prepare immigration documents competently.

Sample Travel Document

Beginning in 2003, a new type of travel document was issued for both re-entry permits and refugee travel documents, which previously each had its own immigration document.

A re-entry permit is issued to permanent residents to allow them to re-enter the United States after extended stays of longer than a year, or where a question of taking up residency in another country may arise, which could otherwise result in loss of permanent residency on the ground that it has been abandoned. The permit is valid for two years and is non-renewable. The permanent resident should apply for the permit at least 30 days before leaving the country. If the permanent resident will remain outside the U.S. beyond the period of the re-entry permit, he or she should apply at a U.S. Consulate abroad for a Returning Resident (SB-1) visa. However, neither the re-entry permit nor the SB-1 visa is a guarantee that permanent residency will not be challenged as having been abandoned subsequently, as for example, in the course of processing an application for naturalization or in subsequent removal proceedings.

If you have a question about re-entering the U.S. after travelling abroad as a permanent resident or loss of permanent resident status through abandonment, please contact Messing Law Offices for a free seven minute telephonic consultation or to schedule an initial consultation.

The refugee travel document functions like a passport for refugees who cannot obtain a passport from their own country for political reasons that led to status as a refugee. It is issued for a period of one year.

Effective September 30, 1997 neither document is suitable proof of employment eligibility.
