  Unauthorized stay or employment can bar chances for visas, but spouses and other immediate relatives of U.S. citizens applying for permanent residency from WITHIN the US by adjustment of status are forgiven. If an immediate relative tries to obtain the same benefit from WITHOUT the U.S. at a consulate or embassy, s/he can be barred for at least three years if any prior period spent inside the US without legal status exceeded six months.

The selection of documents is not the full range of immigration documents, but they are ones that are commonly encountered in practice. The last one, the Notice to Appear, is a document that is served by the Government on a person whom it wishes to deport (remove) in order to commence legal proceedings.

For a more complete range and discussion of documents in connection with employment eligibility, please consult the latest version of the official M-24 Handbook, which is periodically revised. The form I-9, which recently has been modified a number of times, also contains a list of acceptable documents for employment eligibility purposes. Click here to access the latest version of the form I-9. Certain prior editions of the form I-9 are no longer acceptable. Employers should use only the current I-9 form and the list of documents attached to it. List A documents satisfy both identity and employment eligibility in a single document; List B documents establish identity, and List C documents establish employment eligibility. As under earlier I-9 practice, a new hire must present either one eligible List A document or a combination of one List B and one List C document. An employer must respect the employee's choice and is not legally allowed to require an employee to furnish additional documentation if the documents selected by the employee satisfy the acceptable categories, reasonably appear to be valid on their face and relate to the employee.
